Our terms and conditions

This website is owned and operated by ZENBUU Pty Ltd (ABN 44 129 367 504) ("Zenbuu", “we”). Your access to this website is governed by these Terms and Conditions, Privacy Policy, Links and any other rules and conditions within the website (known collectively as the "Terms and Conditions"). By using and/or accessing the Zenbuu website, you agree to be bound by these Terms and Conditions, and any subsequent changes we make to these. Please read them carefully.

Your subscription

By completing and submitting the subscription form on this site, and upon a validation of those details, and receipt of a successfully processed payment, you will be able to access the services provided by Zenbuu. We will provide you with a confirmation notice of your subscription and payment, and a confirmation email with your login details.

All subscriptions are non-transferable.

As a subscriber you acknowledge that:


If you choose a login user name that, in our sole discretion, is obscene, indecent, abusive or which might otherwise subject us to public disparagement or scorn, we reserve the right, without prior notice to you, to automatically change your username, delete your posts from Zenbuu, deny you access to Zenbuu, or any combination of these options.


Charges

The subscription charge to access the Zenbuu website is dependent upon the subscription option selected.  The individual subscription charges ranges and is shown at the time the subscription is taken out. We retain the right to change subscription charges without notice. All subscription charge quoted on the site excludes all taxes and statutory charges.

Those charges are payable annually in advance and will be automatically charged to the nominated credit card, details provided by you. The security of your credit card details is highly regarded and considered.  Should you have any concerns regarding this service, please Contact Us.

Termination of your subscription

You may terminate your subscription at any time. Click on Contact Us and request termination of your subscription. We have a no refunds policy.

Our obligations

Zenbuu makes every practical effort to ensure the security of our subscribers in their dealings with us. We wish to advise that you are responsible for protecting the confidentiality of your login information. You must not make your password available to anyone else. Furthermore, you are responsible for protecting against unauthorised use of your credit card and agree to accept all subscription transactions incurred via your login and password.

We have the right to change or discontinue any feature of the website including content, hours of availability and equipment required for access.

We will use all reasonable endeavours to ensure that the website and the facilities thereon (including diagnostics, plans, knowledge base resources, newsletters, personal email and chat forums and other communication services) is/are available at all times and that the content provided by Zenbuu is true, accurate and error free.

We will use all reasonable commercial efforts to provide the Zenbuu services in a timely fashion and with due care, competence and diligence, however you agree that the quality of the services provided by Zenbuu will depend on:

Your obligations

You must not disclose your login information to anybody or any entity other than Zenbuu. You must also not store your login information anywhere in which those details could be seen, read or heard by anybody other than Zenbuu. You must not use someone else’s login details.

You must not use Zenbuu for any activity whatsoever which in any way breaches any laws, codes or standards. You must also not use the website for any activity which may infringe any third party's rights. You must also not use Zenbuu in any way whatsoever which may be deemed to constitute intimidatory, harassing, menacing, abusive, defamatory or obscene behaviour. In general, you must not send any unsolicited or unwelcome messages or email to anyone using any of the services on the website. 

You indemnify Zenbuu from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to the use of Zenbuu by you or any other person using your subscription details.

You must provide us with accurate information in response to any of the questions that we ask in connection with the products or services provided by Zenbuu. You agree that any decisions that you make in connection with the use of Zenbuu that are not in accordance with our recommended uses for Zenbuu are not within the scope of our duty of care, and in making such decisions you acknowledge and agree that you are taking into account a range of factors beyond the scope of our work and our control. Accordingly, you agree that we are neither responsible nor liable for any such decisions made by you.

You agree that we are entitled to rely on the accuracy and suitability of the information you provide without independently verifying it.


Changes To Your Subscription

Zenbuu may vary the Terms and Conditions at any time without notice to you. Your continued use of Zenbuu will constitute acceptance of any variations to the website by us. It is your responsibility to check the Terms and Conditions of Zenbuu.

If, in Zenbuu’ opinion, you breach any of these Terms and Conditions, we may terminate your access to Zenbuu without notice and without any entitlement to a refund.

Our communication services and links

The Zenbuu website includes electronic bulletin boards, chat forums and other communication facilities ("Communication Services") and links to other websites ("Links").

Zenbuu may contain links to other Internet sites owned by third parties. Your use of each of those sites is subject to the conditions, if any, that each of those sites has posted. We have no control over sites that are not ours and we are not responsible for any changes to or content on them. Our inclusion on Zenbuu of any third party content or a link to a third party site is not an endorsement of that content or third party site.

We will not be liable to you for any failure or delay in delivering the Zenbuu services to you if that failure or delay arises from anything beyond our control, including any delay by you in performing your obligations.


Content on Zenbuu


Zenbuu includes a combination of content that we create, that our partners create and that our users create. All materials published on our sites, including, but not limited to, written content, templates, checklists, forms, articles, questions, answers, comments, recommendations, photographs, graphics, images, illustrations, marks, logos, sound or video clips and flash animation, are protected by our copyrights or trademarks or those of our partners.

You may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display or in any way exploit any of the materials or content or our sites in whole or in part. You are solely responsible for all materials, whether publicly posted or privately transmitted, that you upload, post, email, transmit or otherwise make available on Zenbuu ("Your Content"). You hereby grant us, our affiliates, and our partners a worldwide, irrevocable, royalty-free, nonexclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute and publish Your Content and subsequent versions of Your Content for the purposes of (i) displaying Your Content on Zenbuu, (ii) distributing Your Content, either electronically or via other media, to users seeking to download or otherwise acquire it, and/or (iii) storing Your Content in a remote database accessible by end users, for a charge. This license shall apply to the distribution and the storage of Your Content in any form, medium, or technology now known or later developed.

We do not guarantee the accuracy, integrity or quality of the content on Zenbuu. The content and  services provided by Zenbuu are intended for use in general situations that do not have unusual circumstances. The content and services are not a substitute for professional advice concerning your specific circumstances. We have the right, but not the obligation, to remove any content that may, in our sole discretion, violate these Terms and Conditions or that is otherwise objectionable.

The technology and software underlying Zenbuu and the services provided is the property of Zenbuu, our affiliates and our partners. You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in or otherwise transfer any right to the technology or software underlying Zenbuu or the services. You agree not to modify the software underlying Zenbuu in any manner or form, or to use modified versions of such software, including (without limitation) for the purpose of obtaining unauthorised access to Zenbuu.

Without limiting the foregoing, you agree that you will not use our sites to take any of the following actions:

 

You agree to use our bulletin board services, chat areas, news groups, forums, communities and/or message or communication facilities (collectively, the "Forums"), only to send and receive messages and material that are proper and related to that particular Forum.

Conduct rules


The following conduct is not allowed on Zenbuu, in forums, user profiles, Ask Zenbuu, Forums, talkback, private messages, feedback forms, user reviews, comments or ratings:

 

Messages and topics may be removed at any time and for any reason at the sole discretion of our editors and designated moderators. Subscriber accounts may be warned, suspended, or revoked at any time and for any reason at the sole discretion of Zenbuu and / or our designated moderators. All determinations of what is "acceptable" and "unacceptable" content will be determined solely by Zenbuu or our moderators.

Intentional, repeated, or severe violations are cause for the banning of your account, all use of the site from your IP address or your entire ISP. In such event, we also reserve the right to contact your ISP concerning your activities.


Disclaimer / Liability


Use of the Zenbuu website and of all the facilities therein, and any material or information obtained from this website is at your own risk, and Zenbuu expressly disclaims, to the fullest extent permitted by applicable law, all warranties, expressed or implied, of any kind whatsoever.

In addition, Zenbuu shall not be responsible for the failure or performance of this website and/or the software used in connection with it; the loss of data or services resulting from delays, non-deliveries, misdeliveries, or service interruptions; the accuracy, quality, timeliness, completeness or nature of information obtained through its services; any omission in the information provided; nor the consequences arising from or related to any viruses transmitted through its services, or any liability, costs, loss of profits or consequential loss arising from your use of, or inability to access this website.

Intellectual property

In this Agreement, “Intellectual Property” means all forms of intellectual property throughout the world including copyright, registered patent, design, trade mark and confidential information, including know-how and trade secrets.


We and others own, retain and reserve all Intellectual Property rights, including copyright, in Zenbuu, its products or services and all associated materials, including without limitation, any reports, documents, templates, forms, agreements or advices produced in connection with Zenbuu, before or during this Agreement, and any material, methodologies, software, know-how or procedures notified or provided to you. Except as expressly provided for in this Agreement, nothing set out in this Agreement shall be construed as conferring to you any license or right, by implication or otherwise, under copyright or other Intellectual Property laws.

You may not copy, modify, reproduce, republish, post, transmit or distribute in any way any material from this website including the underlying code and software, save as authorised by these Terms and Conditions. Zenbuu reserves the right to sue for breach of its intellectual property rights.

You are only authorised to use this website and its contents within your own business and/or non-commercial use. You may not use any part of the material on the website to establish, maintain or aid in the establishment or maintenance of your own publications, internet or other, or own competing service offerings.

Mirroring any content from the Zenbuu website is expressly prohibited without the prior written consent of Zenbuu.

Jurisdiction

These Terms and Conditions will be governed by the laws of the State of New South Wales without reference to rules governing choice of laws. Any action relating to these Terms and Conditions must be brought in the Courts of the State of New South Wales.
